Refund and Cancellation Policy

  1. Policy Statement and Purpose
    Initiate Global Foundation, Inc. (“Initiate Global,” the “Foundation,” “we,” “us,” or “our”) is a non-stock, non-profit organization acting as a foundation and as a conduit between donors, partner foundations, campaign creators, and beneficiaries.

    This Refund and Cancellation Policy (“Policy”) sets out the limited circumstances under which refunds may be granted, the treatment of cancelled campaigns, and the procedures for refund requests. The Policy is intended to balance donor protection, legal compliance, and the operational realities of crowdfunding, while preserving the integrity of the platform.

    Initiate Global facilitates fundraising and oversight but does not guarantee project outcomes. Campaign creators may post campaigns subject to review and moderation, and Initiate Global retains the authority to suspend, remove, or cancel campaigns where necessary to protect donors or comply with law.

  2. Scope and Application
    This Policy applies to all donors, campaign creators, beneficiaries, and users participating in campaigns hosted or facilitated by Initiate Global.

    By making a donation, launching a campaign, or otherwise using the platform, you acknowledge and agree to be bound by this Policy.

  3. Refund-Eligible Events
    Refunds are exceptional and shall be granted only in the following circumstances:

    3.1 Campaign Cancellation by Creator
    If a campaign is voluntarily cancelled by the campaign creator prior to fund disbursement, all donor contributions shall be refunded to the original payment method, net of non-refundable payment processing, banking, or currency conversion fees.

    3.2 Failed Verification, Fraud, or Policy Violations
    Where a campaign:

    1. Fails Know-Your-Customer (KYC), Anti-Money Laundering (AML), or sanctions screening;
    2. Is determined to be fraudulent, misleading, or in violation of Initiate Global’s Terms of Use, Content and Acceptable Use Policy, or Disclosure and Transparency Policy; or
    3. Presents material misrepresentation or misuse of funds,

    Initiate Global may freeze the campaign and initiate refunds to donors to the extent legally and operationally possible, subject to regulatory clearance and payment gateway constraints.

    3.3 Legal or Regulatory Orders
    Initiate Global shall comply with valid court orders, regulatory directives, or lawful instructions from competent authorities. In such cases, funds may be:

    1. Returned to donors;
    2. Temporarily held pending investigation or clearance; or
    3. Disposed of in accordance with applicable law.

    3.4 All-or-Nothing Campaigns
    For campaigns designated as all-or-nothing:

    1. If the funding goal is not met by the stated deadline, all donations shall be automatically refunded;
    2. If the goal is met and funds are disbursed, refund eligibility shall be governed by the restrictions in this Policy.
  4. Refund Request Timeframes
    1. Donors must submit refund requests within thirty (30) calendar days from the occurrence of the refund-eligible event (e.g., campaign cancellation, fraud determination, or failed verification notice).
    2. Requests submitted beyond this period may be denied, particularly where funds have already been lawfully disbursed and utilized.
    3. Late requests may be considered only if required by law, regulatory directive, or the outcome of an official investigation.
  5. Refund Request and Processing Procedure
    5.1 Submission of Requests
    Refund requests must be submitted through the platform’s designated refund request form or via email at [email protected], and must include:
    1. Campaign name and URL;
    2. Transaction reference number;
    3. Date and amount of donation; and
    4. Original payment method used.

    5.2 Review and Verification

    1. Initiate Global will review and verify refund requests to confirm eligibility and transaction authenticity.
    2. Approved refunds shall be processed back to the original payment method, subject to payment gateway rules.
    3. Typical processing time ranges from five (5) to fifteen (15) business days, but may vary depending on financial institutions or third-party service providers.

    5.3 Non-Refundable Charges
    The following amounts are non-refundable:

    1. Payment gateway, bank, or card processing fees;
    2. Currency exchange or conversion charges;
    3. Charges that are irrecoverable from third-party service providers.

    Initiate Global shall not be liable for delays or failures attributable to banks, payment gateways, or external service outages.

  6. Non-Refundable Situations and Limitations
    Refunds shall not be granted in the following circumstances:
    1. Funds have already been disbursed and used in accordance with the approved project plan;
    2. Dissatisfaction with campaign progress, project outcomes, or use of funds that remains within disclosed objectives;
    3. Delays in reward delivery, changes in specifications, or production challenges;
    4. Donations or payments made outside the Initiate Global platform.

    Notwithstanding the foregoing, Initiate Global may facilitate refunds or remedial measures on a case-by-case basis where there is verified evidence of fraud, material misuse of funds, or legal violation.

  7. Compliance, Monitoring, and Abuse Prevention
    1. All refund requests, determinations, and transactions are logged and subject to audit.
    2. Suspicious refund activity, chargeback abuse, or false claims may result in account suspension, campaign removal, or referral to regulatory or law enforcement authorities.
    3. Initiate Global complies with the Anti-Money Laundering Act (Republic Act No. 9160), Data Privacy Act of 2012 (Republic Act No. 10173), and other applicable laws.
  8. Limitation of Liability
    1. Initiate Global acts as a facilitator and fiduciary intermediary, not as a guarantor of campaign success or outcomes.
    2. The Foundation shall not be liable for project delays, failure to achieve objectives, or post-disbursement misuse of funds beyond its reasonable oversight and enforcement powers.
    3. Donors acknowledge that crowdfunding involves inherent risks and that refunds are not guaranteed except as expressly provided in this Policy or required by law.
  9. Relationship to Other Policies
    This Policy shall be read together with Initiate Global’s:
    1. Terms of Use;
    2. Content and Acceptable Use Policy;
    3. Disclosure and Transparency Policy; and
    4. Audit and Reporting Framework.

    In case of inconsistency, Initiate Global reserves the right to interpret and apply these policies in a manner consistent with donor protection, legal compliance, and its charitable mission.

  10. Acknowledgement
    By making a donation, launching a campaign, or otherwise using the Initiate Global platform, you acknowledge that you have read, understood, and agreed to this Refund and Cancellation Policy.
