1. Introduction and Acceptance
   These Donor and Backer Acknowledgement and Pledge Terms (“Terms”) apply to all individuals or entities (“you,” “Donor,” or “Backer”) who make a donation or pledge through the Initiate Global Foundation, Inc. (“Initiate Global,” “Foundation,” “we,” “us,” or “our”) platform.

   Initiate Global is a non-stock, non-profit organization acting as a foundation and conduit between donors and campaign creators. By ticking the required checkbox, clicking “Donate” or “Pledge,” or otherwise indicating acceptance, you confirm that you have read, understood, and agreed to these Terms.

2. Voluntary and Conditional Nature of Contributions2.1 Voluntary Contribution
   You acknowledge that:
   
   1. Your donation or pledge is made voluntarily and in good faith;
   2. Contributions are generally non-refundable except as expressly provided in the Refund and Cancellation Policy;
   3. Once funds are verified and disbursed to the campaign creator, refunds are typically unavailable;
   4. Initiate Global is not a bank, financial institution, escrow agent (unless expressly stated), trustee, or investment adviser.

   2.2 No Ownership or Financial Rights
   Your contribution:

   1. Does not earn interest;
   2. Does not create equity, ownership rights, or creditor claims;
   3. Does not entitle you to dividends, profit-sharing, repayment, or financial return;
   4. Does not grant control over project assets or decision-making.
3. Acknowledgement of Campaign Risks
   You understand and accept that crowdfunding involves inherent risks, including but not limited to:
   
   1. Project delays, cost overruns, or operational setbacks;
   2. Failure to achieve stated goals or intended impact;
   3. Non-delivery or delayed delivery of rewards;
   4. Mismanagement or misuse of funds by a campaign creator despite platform safeguards.

   Initiate Global conducts compliance reviews and monitoring in accordance with its policies but does not guarantee the accuracy, feasibility, or completion of any campaign.

   You agree to contribute only amounts you can afford to lose.

4. Role of Initiate Global
   Initiate Global:
   
   1. Provides fundraising infrastructure and compliance oversight;
   2. Reviews campaigns for policy compliance;
   3. May suspend, freeze, or remove campaigns where necessary;
   4. Does not manage, execute, supervise, or control the day-to-day operations of campaigns.

   Campaign creators act independently and bear sole responsibility for project execution and lawful use of funds.

5. Rewards and Fulfilment
   Where rewards are offered:
   
   1. Rewards are tokens of appreciation and not commercial sales or investments;
   2. Fulfilment is the sole responsibility of the campaign creator;
   3. Delivery timelines are estimates only and may change due to production, logistical, or external factors;
   4. Availability may depend on production capacity and supply constraints.

   Shipping fees, customs duties, VAT, or other taxes are your responsibility unless explicitly stated otherwise in the campaign description.

6. Updates and Transparency
   You are entitled to:
   
   1. Receive periodic updates from campaign creators regarding project progress and use of funds;
   2. Review final reports or summaries where required by platform policy.

   If you suspect misuse or misrepresentation, you may report concerns through Initiate Global’s reporting mechanisms.

7. Off-Platform Transactions and Communication
   7.1 Platform-Only Transactions
   All donations must be processed exclusively through the Initiate Global platform.

   If you choose to send funds directly to a creator via personal bank transfer, messaging apps, cryptocurrency, or social media platforms, you do so entirely at your own risk.

   Initiate Global:

   1. Does not monitor off-platform transactions;
   2. Cannot verify or trace such transfers;
   3. Will not mediate disputes arising from off-platform payments.

   7.2 Communication Boundaries
   Campaign creators are prohibited from soliciting donations outside the platform. If you encounter such requests, you are encouraged to report them immediately.

8. Privacy and Data Protection
   
   1. Your personal information is processed in accordance with the Privacy Policy;
   2. Data is handled in compliance with the Data Privacy Act of 2012 (Republic Act No. 10173);
   3. Limited donor information may be shared with campaign creators solely for reward fulfilment and communication purposes;
   4. Initiate Global does not sell personal data.
9. Limitation of Liability
   To the maximum extent permitted by law, Initiate Global shall not be liable for:
   
   1. Campaign failure or non-completion;
   2. Misrepresentation by campaign creators;
   3. Delays or non-delivery of rewards;
   4. Indirect, incidental, or consequential damages arising from your participation.

   Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.

10. Governing Law
    These Terms are governed by the laws of the Republic of the Philippines and are subject to the dispute resolution mechanisms set forth in the Governing Law and Jurisdiction Clause incorporated into the platform’s Terms of Use.
11. Acknowledgement and Confirmation
    By completing a donation or pledge, you:
    
    1. Confirm that you have read and understood these Terms;
    2. Agree to the Refund and Cancellation Policy, Risk Disclosure Policy, Privacy Policy, and other applicable platform policies;
    3. Accept the inherent risks associated with crowdfunding;
    4. Confirm that your participation is voluntary and informed.

    Your support contributes to meaningful impact and community-driven initiatives, but it is extended at your own discretion and risk.
