Risk Disclosure and Disclaimer Policy

  1. Policy Statement
    This Risk Disclosure and Disclaimer Policy (“Policy”) sets out the material risks associated with using the Initiate Global Foundation, Inc. (“Initiate Global,” “we,” “us,” or “our”) platform and participating in campaigns hosted thereon.

    Initiate Global is a non-stock, non-profit organization acting as a foundation and conduit between donors, campaign creators, and beneficiaries. While we conduct compliance reviews and monitoring in accordance with our governance framework, we do not control day-to-day project execution and do not guarantee campaign outcomes.

    By accessing or using the platform, users acknowledge that they understand and voluntarily assume the risks described in this Policy.

  2. Campaign-Related Risks
    2.1 No Guarantee of Accuracy or Success
    Campaigns are independently managed by their respective campaign creators (“Creators”). Although Initiate Global reviews campaigns for compliance with its policies, we do not guarantee:
    1. The accuracy, completeness, or reliability of campaign descriptions;
    2. The financial capability, operational competence, or integrity of Creators;
    3. The achievement of campaign goals or intended impact; or
    4. The quality, availability, or timely delivery of rewards.

    All representations regarding projects are made by the Creator, not by Initiate Global.

    2.2 Risk of Failure, Delay, or Misuse
    Crowdfunding inherently involves risk. Campaigns may fail to meet objectives, encounter delays, or face unforeseen operational, financial, or regulatory challenges.

    In rare cases, funds may be misused despite screening and oversight mechanisms. Donors acknowledge that contributions are voluntary and should be made only in amounts they can afford to lose.

    2.3 No Fiduciary or Trustee Relationship
    Initiate Global does not act as a trustee, financial adviser, or guarantor for donors or Creators. Except where required by law, no fiduciary relationship is created by use of the platform.

    Creators bear sole responsibility for the lawful and ethical use of funds received.

  3. Platform and Technology Risks
    3.1 “As Is” and “As Available” Basis
    The platform and its services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

    To the fullest extent permitted by law, Initiate Global disclaims warranties relating to:

    1. Continuous, uninterrupted, or error-free access;
    2. Compatibility with specific devices, browsers, or operating systems;
    3. Freedom from viruses, malware, or harmful components;
    4. Accuracy or reliability of user-generated content.

    3.2 Cybersecurity and System Risks
    While Initiate Global implements reasonable and industry-aligned security measures, no digital system is entirely immune from cybersecurity threats, data breaches, or service interruptions.

    Users are responsible for safeguarding their login credentials and reporting suspicious activity promptly.

  4. Limitation of Liability
    To the maximum extent permitted by applicable law, Initiate Global, its trustees, officers, employees, contractors, and affiliates shall not be liable for any:
    1. Indirect, incidental, special, exemplary, punitive, or consequential damages;
    2. Loss of profits, goodwill, reputation, or anticipated savings;
    3. Loss of data or business interruption;
    4. Damages arising from reliance on user-generated content or Creator representations;
    5. Losses resulting from delays, interruptions, unauthorized access, or technical failures.

    In all cases where liability is established by competent authority and cannot be lawfully excluded, Initiate Global’s total liability shall not exceed the amount of platform fees actually received by Initiate Global in connection with the specific transaction giving rise to the claim.

    Nothing in this Policy shall exclude or limit liability where such exclusion is prohibited by law.

  5. Third-Party and External Risks
    5.1 Off-Platform Interactions
    Initiate Global is not responsible for any communication, transaction, or agreement between users that occurs outside the platform.

    If a user chooses to transact or communicate outside the platform environment, such actions are undertaken at their own risk.

    5.2 External Links and Services
    Campaigns or platform pages may contain links to third-party websites or services. These links are provided for convenience only.

    Initiate Global does not endorse, control, or assume responsibility for third-party content, policies, or services.

    5.3 User Disputes
    Disputes between donors and Creators must be resolved directly between the parties. While Initiate Global may, at its discretion, facilitate mediation or review compliance issues, it is not obligated to enforce private agreements or guarantee outcomes.

  6. Force Majeure
    Initiate Global shall not be liable for any delay or failure in performance resulting from events beyond its reasonable control, including but not limited to:
    1. Natural disasters, fire, flood, earthquake, or other acts of God;
    2. War, terrorism, civil unrest, or governmental action;
    3. Regulatory restrictions or changes in law;
    4. Internet outages, power failures, or telecommunications disruptions;
    5. Cyberattacks or failures originating from third-party infrastructure providers.

    Such events shall not constitute a breach of any obligation owed by Initiate Global under applicable agreements.

  7. Governing Law and Jurisdiction
    Use of the platform and interpretation of this Policy shall be governed by the laws of the Republic of the Philippines.

    Disputes shall be resolved in accordance with the Governing Law and Jurisdiction Clause and related dispute resolution provisions incorporated into the Foundation’s Terms of Use.

  8. Acknowledgement of Risk
    By accessing or using the Initiate Global platform, making a donation, or launching a campaign, you:
    1. Acknowledge the inherent risks associated with crowdfunding and digital platforms;
    2. Confirm that you have independently evaluated the risks of participation;
    3. Accept that Initiate Global acts solely as a platform facilitator and compliance overseer, not as a guarantor of success or repayment; and
    4. Agree to the limitations and disclaimers stated in this Policy.
